US Department of Labor issues emergency temporary standard to protect workers from coronavirus

The U.S. Department of Labor’s Occupational Safety and Health Administration today announced a new emergency temporary standard to protect more than 84 million workers from the spread of the coronavirus on the job. The nation’s unvaccinated workers face grave danger from workplace exposure to coronavirus, and immediate action is necessary to protect them.

Under this standard, covered employers must develop, implement and enforce a mandatory COVID-19 vaccination policy, unless they adopt a policy requiring employees to choose to either be vaccinated or undergo regular COVID-19 testing and wear a face covering at work.

Since 2020, the coronavirus has led to the deaths of 750,000 people in the U.S., and the infection of millions more, making it the deadliest pandemic in the nation’s history. Many of the people killed and infected by this virus were workers whose primary exposures occurred at their jobs. OSHA estimates that this rule will save thousands of lives and prevent more than 250,000 hospitalizations due to workplace exposure to COVID-19 over the course of the ETS.

“COVID-19 has had a devastating impact on workers, and we continue to see dangerous levels of cases,” said U.S. Labor Secretary Marty Walsh. “We must take action to implement this emergency temporary standard to contain the virus and protect people in the workplace against the grave danger of COVID-19. Many businesses understand the benefits of having their workers vaccinated against COVID-19, and we expect many will be pleased to see this OSHA rule go into effect.”

The emergency temporary standard covers employers with 100 or more employees – firm or company-wide – and provides options for compliance. The ETS also requires employers to provide paid time to workers to get vaccinated and to allow for paid leave to recover from any side effects.

The ETS also requires employers to do the following:

  • Determine the vaccination status of each employee, obtain acceptable proof of vaccination status from vaccinated employees and maintain records and a roster of each employee’s vaccination status.
  • Require employees to provide prompt notice when they test positive for COVID-19 or receive a COVID-19 diagnosis. Employers must then remove the employee from the workplace, regardless of vaccination status; employers must not allow them to return to work until they meet the required criteria.
  • Ensure each worker who is not fully vaccinated is tested for COVID-19 at least weekly (if the worker is in the workplace at least once a week) or within 7 days before returning to work (if the worker is away from the workplace for a week or longer).
  • Ensure that, in most circumstances, each employee who has not been fully vaccinated wears a face covering when indoors or when occupying a vehicle with another person for work purposes.

The emergency temporary standard does not require employers to pay for testing. Employers may be required to pay for testing to comply with other laws, regulations, collective bargaining agreements, or other collectively negotiated agreements. Employers are also not required to pay for face coverings.

“While vaccination remains the most effective and efficient defense against COVID-19, this emergency temporary standard will protect all workers, including those who remain unvaccinated, by requiring regular testing and the use of face coverings by unvaccinated workers to prevent the spread of the virus,” said Deputy Assistant Secretary of Labor for Occupational Safety and Health Jim Frederick. “As part of OSHA’s mission to protect the safety and health of workers, this rule will provide a roadmap to help businesses keep their workers safe.”

OSHA is offering robust compliance assistance to help businesses implement the standard, including a webinarfrequently asked questions and other compliance materials.

The ETS will cover two-thirds of the nation’s private-sector workforce. In the 26 states and two territories with OSHA State Plans, the ETS will also cover public sector workers employed by state and local governments, including educators and school staff.

Leading companies, including major airlines, manufacturers and retailers, have taken similar actions in recent months – adopting vaccine requirements or regular testing as necessary measures to protect their workers and customers.

The ETS is effective immediately upon its publication in the Federal Register. Employers must comply with most requirements within 30 days of publication and with testing requirements within 60 days of publication.

The ETS also serves as a proposal for normal rulemaking for a final standard. OSHA is seeking comment on all aspects of this ETS and whether the agency should adopt it as a final standard.

OSHA will continue to monitor the status of COVID-19 infections and deaths, as the number of vaccinated people in workplaces and the general public increases and the pandemic evolves. OSHA will update the ETS should the agency find a grave danger no longer exists for the covered workforce (or some portion thereof), or new information indicates a change in measures is needed.

Under the Occupational Safety and Health Act of 1970, employers are responsible for providing safe and healthful workplaces for their employees. OSHA’s role is to help ensure these conditions for America’s workers by setting and enforcing standards, and providing training, education and assistance.

Governor Abbott Discusses Impact Of Border Crisis On Texas Communities With Local Law Enforcement In Midland

Governor Greg Abbott today held a roundtable discussion with local law enforcement in Midland about the ongoing crisis at the southern border and its reverberating impact in communities throughout Texas. The Governor was joined by Texas Department of Public Safety (DPS) Director Steven McCraw, Midland County Judge Terry Johnson, Midland County Sheriff David Criner, and law enforcement representatives from Upton, Ector, Tom Green, Dawson, Martin, Howard, and Andrews counties.During the discussion, Governor Abbott thanked local law enforcement for keeping Texans safe and offered his support in their efforts to mitigate the impact of the border crisis in their communities. Sheriffs thanked the state for being proactive and for coming up with innovative ideas to address this ongoing crisis in the federal government’s absence.

“The Biden administration’s border crisis doesn’t just affect Texans living along the border; it’s being felt by communities throughout Texas,” said Governor Abbott. “With an uptick in deadly drugs like fentanyl, dangerous gang activity, and human trafficking across our state, the State of Texas continues to work closely with local law enforcement to solve these challenges. Texas’ unprecedented response to secure the border and combat the crisis would not be possible without local law enforcement partners here in West Texas and across the state, and we continue to ensure they have the resources needed to keep Texans safe.”

Governor Abbott has taken significant action to secure the border in the wake of the federal government’s inaction. Those actions include:

  • Signing laws that provide $3 billion in funding for Texas’ border security efforts
  • Launching Operation Lone Star and deploying thousands of National Guard soldiers and Department of Public Safety troopers
  • Creating a system to arrest and jail illegal migrants trespassing or committing other state crimes in Texas
  • Signing a budget authorization to build the border wall in Texas
  • Signing a law to make it easier to prosecute smugglers bringing people into Texas
  • Signing 9 laws cracking down on human trafficking in Texas
  • Signing a law enhancing penalties for the manufacturing and distribution of fentanyl
  • Issuing a disaster declaration for the border crisis
  • Issuing an executive order preventing non-governmental entities from transporting illegal immigrants
  • Taking legal action to enforce the Remain in Mexico and Title 42 policies in Texas

A permanent exhibit is housed at Texas Woman’s University in Denton, Texas, and currently features the biographies and photographs of all recipients.

Greenpeace pays $58,450 in criminal restitution and 25 defendants admit guilt in Fred Hartman Bridge takeover

Greenpeace paid $58,450 in criminal restitution to five local police and firefighter agencies as part of a plea agreement with 25 defendants, who executed a “takeover” of the Fred Hartman Bridge, closing the Port of Houston for approximately 24 hours in September 2019, Harris County District Attorney Kim Ogg announced Friday.

“Regardless of motive, it is illegal to risk the lives of law enforcement and ordinary people who must drive the bridge. They wasted the time of police officers and firefighters, who potentially could have been used to respond to real emergencies,” Ogg said.

As part of the agreement, the 11 people who repelled off the bridge in 2019 and the 14 people who helped them including those acting as “spotters,” admitted to their guilt to the charge of Obstructing a Highway.

They also each paid a pre-trial intervention fee of $250, and Green Peace paid $58,450.92 to the agencies affected by their actions.

The agencies compensated include the Harris County Sheriff’s Office, Houston Fire Department, Baytown Fire Department, Harris County Precinct 8 Constable’s Office, and Texas Parks & Wildlife.

The defendants repelled off the bridge and unfurled long flags to gain attention the day of a national Democratic debate of presidential hopefuls.

The group stopped traffic on the bridge and along State Highway 146, as well as ships navigating the channel and Gulf Intercostal Waterway.

The defendants were from at least 13 different states and the District of Columbia. None lived in Texas.

The case was prosecuted by Assistant District Attorney George Lindsey.

The Pre Trial Intervention agreement, signed by each defendant, states:

“I am guilty of the offense of Obstruction of a Highway by being a participant in an orchestrated take-over of the Fred Hartmann Bridge in Harris County, Texas. With the intent to comment the offenses, I solicited, directed, aided and attempted to aid , and encouraged others to attach myself and/ or others to the bridge infrastructure, rappel, and suspend myself and/ others above the Port of Houston Ship Channel. Because of my actions, shipping operations ceased for up to an including 24 hours within the Houston Ship Channel, causing unnecessary loss of income to those delayed. I understand that my actions unnecessarily put my life and the life of the first responders who ultimately rescued me, in danger of serious bodily injury and/or death. Additionally, I understand that responding law enforcement agencies utilized scarce life-saving resources that potentially could have been used in other emergencies in removing me from suspension over the Houston Ship Channel.”

Un choque entre dos bandas rivales de narcotraficantes ha sembrado el pánico en la Riviera Maya. Al menos dos personas han muerto tras la irrupción de un comando armado en un hotel de Puerto Morelos, en el Caribe mexicano, han confirmado las autoridades este jueves. El tiroteo provocó que cientos de turistas y trabajadores tuvieran que resguardarse, sin recibir explicaciones de lo que sucedía. Durante poco más de una hora no hubo información oficial sobre el enfrentamiento y reinó el caos y la confusión, en una región mundialmente conocida por su atractivo turístico pero que ha visto en los últimos años cómo la criminalidad y la violencia se han disparado. La Fiscalía local confirmó que dos personas murieron en el lugar, pero agregó que no hubo turistas lesionados de gravedad.

Los informes policiales dan cuenta de que 15 hombres que portaban armas largas entraron a través del área de playa que une a los hoteles Hyatt Ziva Riviera y Azul Beach. Las autoridades han informado de que al menos una turista recibió atención médica después de sufrir un golpe. Las primeras versiones aseguraban que se trataba de un secuestro. Esta información fue desmentida por la Fiscalía, aunque sí se supo que los perpetradores huyeron tras robar una lancha. “Se dirigieron directamente a las dos personas que permanecían en la zona de playas, capturando a uno de ellos, mientras que otro corrió hacia el interior de un centro de hospedaje donde finalmente quedó sin vida, mientras que al otro sujeto lo privaron de la libertad y metros adelante de la vida, dándose a la fuga”, señaló la Fiscalía en un comunicado.

La bahía de Petempich, donde desembarcó el comando, se encuentra entre los centros turísticos de Cancún y Playa del Carmen, a unos 20 kilómetros del aeropuerto internacional. La Policía local se limitó a informar que se había trasladado a la localidad, un antiguo puerto de pescadores que ha ganado adeptos por estar lejos del ajetreo recurrente del corredor turístico, tras recibir una llamada de emergencia. “Se reportó al 911 una actividad irregular suscitada en las inmediaciones de un hotel”, ha informado.

Pero esa llamada “actividad irregular” es cada vez más común en el Estado de Quintana Roo, que concentra otros destinos de reputación mundial en el Caribe mexicano. La violencia no ha dado tregua. Esta misma semana, el cuerpo de un hombre maniatado fue abandonado en un parque de Cancún. Un tiroteo en un bar de Tulum provocó el pasado 20 de octubre la muerte de dos turistas extranjeras, una india y una alemana, y otros tres resultaron heridos. Un mes antes, un taxista y un guardia de seguridad fueron acribillados en otro tiroteo en la localidad. En agosto, un hombre murió tras recibir un disparo en la nuca, también en Tulum.

Mientras la noticias de sucesos violentos llegan desde el Caribe, el gobernador del Estado, Carlos Joaquín, anunció esta semana que la Policía de Tulum había contratado a más elementos para llegar a tener 500 agentes en total y encarar la violencia. “Todos somos culpables, de alguna manera y es por eso que el reto es recobrar esa imagen de un destino de éxito y seguro”, dijo el martes Joaquín, que no se pronunció en público al menos en las seis horas que siguieron al tiroteo. “Es un hecho que lastima a nuestra sociedad y la búsqueda de tranquilidad en la que trabajamos. Seguiremos investigando junto con las fuerzas federales hasta dar con los responsables”, lamentó finalmente por la noche el gobernador.

Quintana Roo ha rebasado el umbral de los 1.000 homicidios durante los primeros nueve meses del año, según los últimos datos oficiales disponibles. La última Encuesta Nacional de Victimización y Percepción sobre Seguridad Pública (Envipe), un termómetro oficial sobre la violencia en el país, señala que ocho de cada diez habitantes se sienten inseguros en el Estado. La inseguridad es el tema que más preocupa a la población, casi el doble que los problemas que siguen en la lista, como el desempleo y el acceso a los servicios de salud. La criminalidad costó en 2020 a Quintana Roo más de 7.354 millones de pesos, unos 370 millones de dólares y unos 160 millones de dólares más que en 2019, según la Envipe.

On Sunday, October 3, 2021, at approximately 2:00 a.m., Dakota K. Bawary was shot and killed in the 4600 block of W. Orem Dr. in Houston, Texas. During the incident, the victim was at a gathering at the location when unknown suspects and the victim got into an argument. The unknown suspects fired multiple gunshots at the victim striking them. The suspects fled the scene. The victim died as a result of the gunshot injuries they sustained during the shooting.

The family of Dakota K. Bawary is requesting the community’s help with identifying the suspect(s) responsible for this murder.

Latino arts initiative awarded up to $1 million from Houston Endowment

Phase 1 kicks off the planning of a First-Class Latino Cultural & Visual Arts Complex in Houston

Houston Endowment, a private philanthropic institution dedicated to a thriving Greater Houston, recently awarded up to $1 million to Advocates of a Latino Museum of Cultural and Visual Arts & Archive Complex in Houston, Harris County (ALMAAHH). The investment will support the planning phases of the initiative to create a first-class Latino cultural and visual arts complex in Houston. The initial phase will include outreach, learning, listening, connecting stakeholders — such as Latino arts groups  —  as well as connecting to potential consumers and users to create a community-driven roadmap that will help make the project a success.

“We have a long-standing commitment to Houston’s vast arts scene as it can uniquely capture the stories and traditions of our city’s residents,” said Houston Endowment President and CEO Ann Stern. “We’re proud to support the community’s efforts to establish a new cultural asset that will amplify the experience of Houston’s Latino traditions.”

“We have the unapologetically large dream of creating a home for the diverse, robust, and authentic culture of Latinos in Houston. To showcase and grow opportunities for Latino artists and artisans, our culinary arts as well as performing arts is a winning strategy for cultural equity and economic opportunity for Latinos. This will be our gift for all Houstonians,” said Geraldina Interiano Wise- Artist, Board Chair of ALMAAHH.

Phase 1 activities will include in-depth research into available resources and community needs, input from stakeholders and community members through focus groups and town hall meetings, and the creation of a roadmap for the next steps. Concurrently there will be research and benchmarking institutions around the state and country to learn not only what is the ecosystem of Latino arts but also to launch future-forward ideas on breaking open the museum model to better serve Latinos in an authentic and inclusive way.

Phase 2 is expected to focus on feasibility studies and site analysis of a few different locations, the creation of a master and urban plan, architectural design, and programming of the complex. The focus will be to serve local needs while also becoming a world-class destination for visitors.

Phase 3 will focus on the construction of the complex, which ALMAAHH leadership envisions will become a new tourist destination and will help elevate Houston as a national hub of Latino culture.

ALMAAHH’s vision has already received enthusiastic support and recognition from prominent Houston-area leaders. Though the first phase of the initiative is just beginning, support from the City of Houston already has included $40,000 in seed money from Council Member Karla Cisneros and $110,000 from Council Member Robert Gallegos, with Mayor Sylvester Turner’s support. Harris County Commissioner Adrian Garcia is lending his support in identifying potential Harris County land for the complex.

Community support also has been very strong. Spearheaded by co-chairs Paula Mendoza and Wendy Montoya Cloonan, Cien Latinos por la Cultura, ALMAAHH’s first fundraising campaign, concluded successfully. The grassroots campaign gave the community an opportunity to help get the initiative off the ground by providing seed money. The goal was to reach 100 donors, which was exceeded, with the campaign raising nearly $100,000.

In addition, a community celebration was held recently, bringing together Houston’s Latino community, art lovers, artists, public officials, heads of major institutions & philanthropy, and Latino donors to officially kick-off initiative activities. The Board of Directors was introduced, Board Chair of ALMAAHH- Geraldina Interiano Wise- shared the Board’s vision and next steps in this endeavor. The Co-Chairs gave testimonials as to why creating a place for our shared Latinidad is important, and donors of the Cien Latinos por la Cultura campaign were spotlighted. Mayor Turner and Council Members Cisneros and Gallegos spoke at the event, expressing their support for the initiative.

La mayoría de la gente vive sin reconocimiento, porque cree que no lo necesita.
Y es que, “en este mundo materialista, el reconocimiento no sirve para comer”, dicen.

Vamos por la vida sin saber qué es el triunfo, y la mayoría llegamos a pensar que la experiencia de “ganar” no es necesaria.

Oímos a innumerables motivadores y “coaches” gritar entusiasmados: ¡sé tú mismo! y ¡logra tus sueños! la mayoría con buena intención, pero sin saber mucho lo que dicen.

Porque ser uno mismo, es ser cualquier cosa.

Quien es flojo mantendrá esa característica porque está siendo él mismo, quien tiene malos hábitos los conservará, porque está siendo él mismo, quien hace ejercicio mantendrá el mismo nivel, si sólo se concentra en ser él mismo.

Ser uno mismo NO nos desafía, y mucho menos nos ayuda a alcanzar nuestros sueños, (si es que tenemos alguno).

Pero SER la mejor versión de uno mismo puede proyectarnos a alcanzar el cielo. La historia del karate se pierde en los anales de la historia.

La isla de Okinawa (ahora parte de Japón) es considerada la cuna del Karate, aunque esta disciplina tiene influencias de China e India.

Puedo entender que mi madre, al verme tan vulnerable a los 12 años, haya tomado la decisión de inscribirme a clases de Karate, pero si soy vulnerable, es porque no tengo lo que se necesita, ¡cómo se le ocurre!
